Preamble
The First Peoples Innovation Center (FPIC) is a leading organization that supports innovative social initiatives where Indigenous and non-Indigenous people collaborate to highlight and activate the full potential of First Peoples, in a context of genuine and lasting reconciliation.
Article 1 – Purpose
These Terms of Use apply to the animation, monitoring and continuing education services in 21st century education offered by FPIC and accessible on the website https://cipp-fpic.com/ (the “Services” and the (“Site”).
This document constitutes an agreement between you (“you” or the “user”) and FPIC (the “Agreement”). This Agreement, the User Agreement and the Privacy Policy set forth the terms and conditions applicable to the Services and the Site. It is binding upon you and applies from the time you browse the Site, use the Services or electronically confirm your acceptance of these terms and conditions.
If you do not accept all of the provisions of this Agreement, you are not authorized to use the Services.
You are authorized to use the Services only in the manner and under the conditions described in this Agreement and in compliance with
applicable laws. FPIC reserves the right to deny access to, exclude or remove, without prior notice and without liability, any user and any
user contribution or comment that violates this Agreement, the User Agreement or the Privacy Policy.
FPIC reserves the right to modify this Agreement, the User Charter and the Privacy Policy. Any changes will be posted on the Site. Your use of the Services following such notice shall constitute your acceptance of such modifications.
Article 2 – Site registration
In order to use the Services, the user must create a user account. The user undertakes to provide truthful and up-to-date information. The user undertakes to take all necessary steps to keep the username and password used to access the Site strictly confidential. Any access and use of the Services made with your identifier will be deemed to have been made by you. In the event of loss or theft of your login and password, or if you become aware of any fraudulent use of your account, you undertake to inform FPIC immediately by e-mail in the “Contact us” section.
Article 3 – Rules of conduct
Users are solely responsible for the content they publish on the Site. Content includes text, photos, videos, blog posts, discussions and comments.
It is forbidden to use the Services for the purposes of disseminating, publishing, transmitting or hosting : (i) content that is illegal, unlawful or harmful to FPIC, other users, or third parties, (ii) material whose purpose is to impersonate any third party, (iii)
material that infringes FPIC’s or third parties’ intellectual property rights, (iv) material that contains computer viruses, malware, or spyware, or any other material that may adversely affect the operation of the Services or the Site or damage the facilities and
systems of FPIC or its service providers.
You shall refrain from any action that may affect the accessibility, security, integrity and functionality of the Website, FPIC’s systems or any subcontractor and shall refrain from any attempt to gain unauthorized access to other users’ data or documents.
In addition, the user undertakes to comply with the legal and regulatory provisions in force, and in particular to refrain from:
- Publish content that is racist, xenophobic, anti-Semitic, homophobic, negationist, pornographic, pedophilic, child pornographic or offensive to human dignity.
- Publish content inciting violence, suicide, terrorism, the use, manufacture or distribution of illegal substances, or inciting the commission of crimes or misdemeanors.
- Publish content that is abusive or defamatory, or that violates the privacy, image or personality rights of third parties.
- Publish content that infringes the intellectual property rights of third parties.
- Use the Site to promote commercial products and/or services. More generally, use of the Site must be consistent with its purpose.
Article 4 – Rules governing the use of content broadcast on FPIC
The user undertakes to respect the conditions of use specific to each content offered on the Site (texts, photographs, videos, etc.). Content published on the Site may only be used, reproduced and distributed for personal, educational or teaching purposes. Unless specific terms of use for a content state otherwise (for example, Content distributed under a free distribution license), it is forbidden to reproduce, modify, sell, sublicense, transfer, or distribute in any format whatsoever, in whole or in part, the contents of the Site. The user accepts that the content he/she publishes on the Site may be used by other users of the Site in accordance with this Agreement.
Article 5 – Collected data – Cookies
Personal data provided by the user will be used, stored and destroyed in accordance with the Privacy Policy.
The non-personal data collected by FPIC is intended to enable the use, operation, improvement and development of the Services offered on the Site.
FPIC uses cookie technology to improve the quality of the Site and better meet user expectations. Cookies are anonymous and are in no way used to collect personal data, but only for connection and statistical purposes.
Article 6 – Intellectual property relating to the Services
The Services are the property of FPIC and are protected by Canadian and international copyright, trademark and other applicable laws. Your use of the Services confers no rights beyond their use in accordance with this Agreement.
The Services may not be copied, reproduced, republished, uploaded, posted, transmitted, modified, indexed, catalogued, decompiled, mirrored or distributed in any way. Trademarks and logos on the FPIC website are the property of FPIC and may not be used without FPIC’s express prior consent.
Article 7 – Responsibilities
User responsibility
To access the Site and use its services, the user must have the necessary hardware and software. The user is solely responsible for the proper functioning of his/her hardware and Internet access. FPIC cannot be held responsible for any failure or loss of data that may result from the use of the Services or the Site.
The user is solely liable to FPIC and, if applicable, to any third party, for any damages, direct or indirect, of any nature whatsoever, caused by any content posted on the Site by the user, as well as for any violation by the user of this Agreement, the User Charter and the Privacy Policy.
FPIC’s responsibility
The FPIC site includes information provided by users or hypertext links to other sites which are not published by FPIC, but provided or offered by third parties. The existence of a link from the Site to another site does not constitute validation or approval of that site or its content. The reasonableness or timeliness, accuracy or completeness of the content of this information is not verified by CIPP.
In this respect, FPIC expressly disclaims any liability other than that expressly stipulated herein. FPIC undertakes, as part of its obligation of means, to deploy the resources and use the appropriate processes and technology in order to provide the Services in an optimal manner, in accordance with the terms and conditions set forth herein.
FPIC aims to maintain the availability of the Services 24 hours a day, 7 days a week, but does not subscribe to any obligation of result.
FPIC therefore reserves the right to interrupt or temporarily suspend access to the Site, in particular for maintenance purposes, without this interruption giving rise to any right to compensation.
In addition, FPIC shall not be liable for any network or server failure or any other event beyond reasonable control that prevents or degrades access. You acknowledge that FPIC does not assume and shall not be liable for any use by you or any third party, or any inability to access or use the Services, or for any content published on the Site.
Except in cases where FPIC has been duly informed of the existence of illegal content within the meaning of current legislation, and has not acted promptly to remove it, FPIC cannot be held responsible for the dissemination of such content.
Article 8 – Jurisdiction
This Agreement is governed by the laws applicable in the Province of Quebec.
Any dispute relating to the interpretation or execution of this Agreement, or grievance relating to the operation of the Site, shall be settled before the courts having jurisdiction in the Province of Quebec.
